Terms of Use

By accessing and using AuctionsByYou, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree to abide by the above, please do not use this service.

You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

All users must complete identity verification before bidding or listing items. We use third-party verification services to confirm your identity and prevent fraud. Your SSN and DOB are securely processed by Stripe and never stored on our servers.

• Auctions are binding contracts. Once you place a bid, you commit to purchase if you win. • Auction duration: When an auction has less than 3 minutes remaining and receives a new bid, it is automatically extended by 2 minutes. • Minimum bid increment: Each bid must be at least $5 higher than the previous bid. • Buy Now: If available, clicking "Buy Now" immediately purchases the item at the listed price. • All auctions are final. Items are sold as-is unless otherwise stated by the seller.

• Bidders must have a verified identity and a valid payment method (credit card or bank account) on file. • Bid retraction is not permitted except in exceptional circumstances (technical error within minutes of placement). • Shill bidding (using other accounts to artificially inflate prices) is strictly prohibited and grounds for immediate account termination. • Automatic bidding: You may set a maximum bid, and the system will bid on your behalf up to that amount.

• Sellers must be verified and have a linked bank account for payouts. • Item listings must be accurate and truthful. Misrepresentation is grounds for removal and account suspension. • Seller contact information and pickup instructions are kept private until an auction ends. Winners will receive this information upon purchase. • You are responsible for coordinating pickup or shipping with the buyer. We do not facilitate logistics. • All items must be legal to sell in your jurisdiction.

Sellers may not list: • Counterfeit or stolen goods • Weapons, firearms, or ammunition • Hazardous materials or recalled items • Illegal drugs or controlled substances • Items that violate intellectual property rights • Adult content or services • Any items that violate local, state, or federal law

Users agree not to: • Engage in fraudulent activity or misrepresentation • Harass, threaten, or abuse other users • Use automated systems or bots to artificially increase bids or access the site • Attempt to manipulate auction results • Post spam or irrelevant content • Attempt to circumvent platform fees or verification • Share account credentials or enable unauthorized access

• Platform Fee (Buyers): 10% of the final winning bid • Platform Fee (Sellers): 10% of the final winning bid • Buy Now Fee: 10% buyer fee + 10% seller fee applied to purchase price • Payment Processing: Stripe processes all payments. Additional payment processor fees may apply. • Admin Accounts: Waived from all platform and buyer/seller fees. • All transactions are subject to applicable state and local sales taxes.

• Payouts are processed via Stripe Connect to your verified bank account. • Payouts are held for 7 days after auction end to allow for disputes. • Your net payout is calculated as: Final Bid - Platform Fee (10%) - Payment Processing Fees. • Stripe may hold additional funds per their standard reserve policies.

• If a buyer and seller cannot resolve a dispute, contact support@auctionsbyyou.com with documentation. • We will investigate disputes within 7 business days. • Evidence may include: auction listing, bid history, communications, and payment records. • We reserve the right to mediate or refund either party based on findings. • Refunds are issued to the original payment method.

AuctionsByYou and all content within (logos, design, code) are the property of AuctionsByYou. You may not reproduce, distribute, or modify any content without permission. User-generated content (auction listings, reviews) remains your property, but you grant us a license to display and moderate it.

AuctionsByYou is provided "as is" without warranties. We are not liable for indirect, incidental, or consequential damages. Our liability is limited to the amount you paid in platform fees within the past 12 months. We do not guarantee uninterrupted service or accuracy of third-party data.

You agree to indemnify and hold harmless AuctionsByYou, its owners, and employees from any claims, damages, or losses arising from your use of the platform, violation of these terms, or violation of any law.

We reserve the right to terminate accounts for violation of these terms, fraudulent activity, or abuse. Terminated users forfeit any pending payouts and are prohibited from creating new accounts.

Your privacy is important to us. Personal information is collected and used in accordance with our Privacy Policy. All financial data is processed by Stripe and complies with PCI DSS standards.

We may modify these Terms of Use at any time. Changes become effective when posted. Continued use of the platform constitutes acceptance of updated terms.
